Hallo Sacha
We've initialized the variable in case of an error but as you've already seen, the problem is that the EU VIES service isn't available 24/7 and to be more precise, its far away from that. Therefore, the ai-vatcheck extension contains a configuration setting to allow orders even if the VIES system is down:
client/html/checkout/standard/address/vatcheck/strict = false
